the room.

By creating an account or using any part of Crafted Nights (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service. The Service is operated by Crafted Nights (“we”, “us”, or “our”).

You must be at least 18 years old to create an account. By registering, you represent that you meet this requirement. Some content within the Service is intended for adults only.

You are responsible for:

• Providing accurate, current, and complete registration information.
• Maintaining the confidentiality of your password and account credentials.
• All activity that occurs under your account, whether or not authorised by you.
• Notifying us immediately at brian.matthews@brainengine.ai if you become aware of any unauthorised use of your account.

We reserve the right to refuse registration or cancel accounts at our discretion.

Crafted Nights offers a free tier and paid subscription plans. Paid subscriptions are billed in advance on a monthly or annual cycle through Stripe.

• Automatic renewal. Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.
• Cancellation. You may cancel at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period; you retain access until that date.
• Free trial. Where offered, a free trial converts to a paid subscription at the end of the trial period unless you cancel before it ends.
• Price changes. We may change subscription prices. We will give you at least 30 days' notice of any price change by email. Your continued use after the notice period constitutes acceptance of the new price.
• Credits. Monthly credits are allocated per subscription tier, do not roll over, and expire at the end of each billing period. One-time credit purchases do not expire.
• Refunds. We do not offer refunds for partial billing periods or unused credits, except where required by applicable law or granted at our sole discretion. If you believe you were charged in error, contact us within 30 days of the charge.
• Taxes. You are responsible for any applicable taxes. Prices are shown exclusive of taxes unless stated otherwise.

All payments are processed by Stripe, Inc. By providing payment information, you authorise Stripe to charge your payment method on a recurring basis. Stripe's terms apply to payment processing.

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law or regulation.
• Harass, threaten, intimidate, or harm any person.
• Transmit unsolicited commercial messages, spam, or phishing content.
• Upload or transmit viruses, malware, or any code intended to disrupt or damage systems.
• Attempt to gain unauthorised access to the Service, its servers, or any connected systems.
• Scrape, crawl, or extract data from the Service using automated means without our prior written consent.
• Circumvent, disable, or interfere with security features, usage limits, or access controls.
• Infringe the intellectual property rights of Crafted Nights or any third party.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Impersonate another person or entity.

We reserve the right to investigate violations and, where appropriate, suspend or terminate accounts without notice.

The Service uses AI (powered by OpenAI) to generate date ideas, activity suggestions, quest narratives, and other content. You acknowledge that:

• AI-generated content is produced algorithmically and may be inaccurate, incomplete, or not suitable for your specific circumstances. It is provided for entertainment and planning inspiration only, not as professional advice (legal, medical, financial, or otherwise).
• You are responsible for reviewing and using AI-generated content at your own discretion.
• We do not guarantee the accuracy, safety, or completeness of AI-generated suggestions.
• You agree not to use AI features to generate content that violates these Terms or applicable law.

The Service and its original content — including designs, text, graphics, UI, code, and the Crafted Nights brand — are the property of Crafted Nights and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our proprietary content without prior written permission.

You retain ownership of any content you create using the Service (e.g. customised kits, saved date plans). By using the Service, you grant us a limited, non-exclusive, royalty-free licence to store and display your content solely as necessary to operate and improve the Service. We do not claim ownership of your content and do not use it for advertising or external commercial purposes.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. THIS IS AN OPEN BETA PRODUCT — FEATURES MAY CHANGE, BE REMOVED, OR BE TEMPORARILY UNAVAILABLE WITHOUT NOTICE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CRAFTED NIGHTS AND ITS OWNERS, OPERATORS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW EXCLUSIONS OR LIMITATIONS OF CERTAIN DAMAGES; IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We may suspend or terminate your account and access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or if we determine termination is necessary to protect the Service, other users, or Crafted Nights.

You may close your account at any time by contacting us at brian.matthews@brainengine.ai or through your account settings. Upon closure, we will delete your personal data in accordance with our Privacy Policy, subject to any legal retention obligations.

These Terms shall be governed by and construed in accordance with the laws of [Governing law: STATE — to be confirmed], United States, without regard to its conflict-of-law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in that state. If you are located outside the United States, you also agree to the transfer of your data to the United States for processing in accordance with our Privacy Policy.

We may update these Terms from time to time to reflect changes in the Service, legal requirements, or our business practices. When we make material changes, we will update the “Last updated” date and notify you by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may close your account.
